Yesterday afternoon I had the privilege and opportunity to participate in oral argument before a five Justice panel in the Appellate Division of the Supreme Court of the State of New York in Manhattan. I represented plaintiffs-appellants who appealed a trial court justice decision denying summary judgment. The case involves UCC claims against a customer’s bank for improper payment of two dual party checks and a missing endorsement shortened notice provision in the bank’s agreement with its customer which we argued was commercially unreasonable and void against public policy. It was a great experience, both interacting with the Justices during my oral argument and listening to over a dozen oral arguments by attorneys handling other appeals which the Justices heard before ours!
