NY UCC Governs Contract Claim for Goods Delivered and Accepted; Lost Profit Counterclaim Dismissed For Lack of Contemplation By Parties and Alleged Damages Speculative

The Law Offices has obtained summary judgment on behalf of a New York women's clothing company that filed suit in 2016 against a national retailer for breach of contract and account stated for failure to pay for purchase order goods delivered and accepted by the retailer.  Manhattan Supreme Court Justice Andrew S.
