Personal Injury Settlement
The Firm has successfully resolved a personal injury claim against our clients, a General Contractor and the Owner of an industrial property being demolished for conversion to commercial usage. The Plaintiff alleged that she was injured in December of 2009 following a snow storm. After normal business hours, the Plaintiff was walking near the construction site on a driveway that was covered in ice and the Plaintiff fell and broke her wrist. The Plaintiff was initially treated in the emergency room and subsequently underwent wrist surgery. Plates and screws were inserted into Plaintiff’s wrist. Plaintiff was instructed to follow a strict physical therapy regimen. During discovery, however, we learned that Plaintiff did not complete physical therapy as instructed. Plaintiff’s employment records were obtained, indicating that the Plaintiff, a graphic artist, did not suffer lost income as a result of the injury. Furthermore, the Plaintiff’s insurance covered substantially all of her medical expenses so Plaintiff suffered minimal monetary damages other than pain and suffering. The matter was settled following Plaintiff’s deposition and before trial.
ACEC Albany
The Law Offices of Marc H. Supcoff attended and sponsored the ACEC NY Winter Conference at the Albany Marriott in January. The event had a great turnout and was attended by engineers.
PWC February 17th, 2011 Networking Event
The Firm attended and exhibited at the PWC’s Meet the Construction Chiefs networking event in February at Club 101. The event was attended by Contractors and had several guest speakers that included a representative from the NYC School Construction Authority and a representative of Tishman Construction Corporation.
Condominium Representation
The Firm has been retained by a Condominium Board in Brooklyn, NY to represent the Condo and its unit owners to pursue a legal claim against the Sponsor for damages stemming from construction defects in the original construction of the Condominium Project. Damages include apartment water intrusion, repeated flooding and poor insulation. The matter is expected to be resolved through the American Arbitration Association.
